Terms of Use and End-User License Agreement
Last updated: October 28, 2026
In plain English
Your organization gets a subscription license, not ownership of the software. You own your data, can disconnect QuickBooks anytime, and can cancel renewal. Refunds are reviewed case by case. The dashboard helps manage your business; it is not accounting or tax advice.
This summary is a guide; the full policy below applies.
1. Agreement and operator
Childcare KPI is operated from Ohio, USA. These Terms of Use and End-User License Agreement ("Terms") govern access to our hosted dashboard and related services. "We," "us" and "our" refer to the operator of Childcare KPI; "you" refers to the subscribing organization and its authorized users. By creating an account or using the service, you accept these Terms. You must be at least 18 and authorized to act for your organization. Contact us at the address below for questions.
2. Subscription license and accounts
Subject to these Terms and any applicable payment, we grant your organization a limited, non-exclusive, non-transferable, non-sublicensable license to access and use Childcare KPI during your trial or subscription for your organization's internal business purposes. The license is per organization and covers its authorized users and subscribed centers, not unrelated organizations. This is access to hosted software, not a sale of the software. You may not resell access, transfer your license, or copy or redistribute the service without our written permission.
The organization owner manages membership and permissions. Keep credentials confidential, provide accurate account information, and notify us of suspected unauthorized access. You are responsible for your authorized users' activity.
3. Free trial
New organizations receive a 14-day free trial without a payment card. The trial does not by itself start a paid subscription. If you choose a paid plan during the trial, review the charge and start date shown at checkout. When trial access ends without a paid plan, the dashboard becomes read-only. This does not automatically delete your data.
4. Monthly and annual billing
Paid subscriptions are billed through Stripe on a monthly or annual basis, at the prices and center quantities displayed when you subscribe. Subscriptions renew automatically at the selected interval unless cancelled before renewal. You authorize Stripe to charge your chosen payment method for recurring fees and applicable taxes. Annual billing charges the annual amount, not monthly installments.
Center additions or removals may change your charges; adjustments and any prorations are determined by the subscription configuration and shown in Stripe. Keep payment details current. A failed payment may result in restricted or suspended access; the app provides a seven-day grace period after a recorded payment failure before read-only access. We announce material price changes before they apply to a future renewal.
5. Promo codes
Promo codes are subject to the eligibility, expiration, duration, and discount conditions shown with the offer and at Stripe checkout. A code must be accepted at checkout to apply. Unless the offer says otherwise, discounts do not apply retroactively, have no cash value, and do not combine with other offers. Any full-price renewal after a promotion follows the terms displayed at checkout.
6. Cancellation and refunds
Organization owners can cancel through Settings → Manage billing in the Stripe customer portal, or contact us if they cannot access it. Cancellation stops renewals according to the effective date shown in the portal. Access and any remaining paid period follow the cancellation details displayed there. Cancelling a subscription does not itself close your account or request deletion.
Refund requests are reviewed case by case. Email info@childcarekpi.com with your organization and the charge you want reviewed; do not send card numbers. A request does not guarantee a refund, and we do not promise automatic prorated refunds for unused time. Any refund approved by us is processed through Stripe to the original payment method where available. Nothing in these Terms limits refunds or other remedies required by applicable law.
7. QuickBooks connection
Connecting QuickBooks is optional. You must have authority to connect the account. Our use of the connection is read-only: we retrieve financial reports and account, class, and location information to populate your dashboard; we do not create, edit, or delete accounting transactions. Intuit's authorization screen describes the accounting access scope; that scope is not a separate read-only permission.
You can disconnect anytime in Settings → QuickBooks, or revoke access in Intuit. Disconnecting stops our future syncing and removes our stored connection tokens; we also request revocation from Intuit. If that request fails, you can revoke directly through Intuit. Previously imported dashboard values are not necessarily deleted by disconnection; request deletion separately. Intuit's own terms continue to apply.
8. Enrollment and Brightwheel uploads
You may upload enrollment and Brightwheel report files in supported formats, including CSV and Excel. Files may contain children's names, schedules, center information, room labels, and counts. You must have the lawful authority to provide that information and give families any required notices or obtain any required permissions. Upload only information needed for the dashboard, not medical records, payment-card data, passwords, or other unnecessary sensitive information.
You are responsible for checking file mappings, schedules, capacities, and results. The service processes files to compute enrollment and occupancy values and room counts. Source errors, duplicate inputs, and incorrect mappings can affect results.
9. Ownership of customer data
You retain ownership of the data you provide and the business information imported on your behalf. You grant us only the rights needed to process, store, and display it to deliver your dashboard and operate your account as described in our Privacy Policy. We do not sell your data or use your financial or enrollment information for advertising or unrelated purposes. The software, branding, and other service materials remain ours or our licensors'.
10. Acceptable use
Do not use the service unlawfully, upload information without permission, access another organization's information, misrepresent your authority, share credentials with unauthorized users, introduce malware, bypass security or usage restrictions, disrupt the service, or reverse engineer it except where applicable law permits. Do not use the service to facilitate fraud or unlawful handling of children's information. We may restrict access to protect users or investigate misuse.
11. No accounting or tax advice; no warranties
Childcare KPI is a business-management dashboard, not accounting, tax, financial, legal, or professional advice. Its numbers are derived from your reports, uploads, and mappings. We do not warrant that results are complete, accurate, current, suitable for tax filings, or compliant with accounting standards. Verify figures against your source records and consult qualified advisers before making material decisions.
To the extent permitted by law, the service is provided "as is" and "as available," without express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted operation or availability of third-party services.
12. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, business opportunities, or data arising from use of or inability to use the service. Our total aggregate liability arising from the service or these Terms is limited to the amounts your organization paid us for the service in the 12 months before the event giving rise to the claim. These limitations apply regardless of the legal theory and do not exclude liability or rights that cannot lawfully be excluded.
13. Suspension, termination, and account closure
You may stop using the service and request account closure at any time. Cancelling billing and closing the account are separate actions; complete cancellation or contact us to arrange it. We may suspend or terminate access for material violations, non-payment, unlawful activity, or security risks, with notice and an opportunity to resolve the issue where reasonably practicable. Immediate action may be necessary to protect people, data, or the service.
When access ends, the license ends. Data retention and deletion follow our Privacy Policy. Ownership, accrued payment obligations, warranty disclaimers, liability limits, and governing-law provisions survive termination to the extent relevant.
14. Ohio governing law
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Subject to any mandatory rights or jurisdiction rules that apply to you, disputes will be brought in courts of competent jurisdiction in Ohio. Nothing here removes protections that applicable law does not allow you to waive.
15. Changes and contact
We display the last-updated date on this page. Material changes to these Terms, including material billing or data-use changes, are announced by email to the account contact or a prominent notice in the app before they take effect, with the effective date stated. Other updates are posted here. Continued use after a change takes effect constitutes acceptance where permitted by law; if you do not agree, stop using the service and cancel before your next renewal.
